A patent application for an airplane designed with a pusher turboprop and a forward mounted retractable fan jet (or other type of jet engine) was filed with the United States Patent Office (USPO) on October 26, 2006, on behalf of Joseph A. Hutterer. On June 23, 2009, the USPO issued patent number 7,549,604. The term of the patent is 20 years from the filing date.
The utility patent for this design provides broad design coverage. The patent does not limit aircraft size and covers various rear propulsion systems such as piston-propeller, fanjet, open rotor, etc. If a competitive aircraft, which uses the hybrid airplane concepts as defined in the patent, is produced in a foreign country, the producer of that aircraft is prohibited from marketing their product in the USA during the life of the patent.
